Shane Scott Hammond, 19, of Boyne City was sentenced to 36 to 60 months in prison on a charge of Attempted Criminal Sexual Conduct, Third Degree in the 33rd Circuit Court in Charlevoix.

Hammond admitted engaging in the sexual penetration of a 13 year old in August of 2015.  In sentencing the defendant, Judge Roy C. Hayes III stated that the facts of the case were that Hammond supplied the victim with LSD, she passed out and he then carried her into his bedroom where he sexually assaulted her.

The Michigan Sentencing Guidelines recommended a minimum sentence of 0 to 17 months but based upon the facts of the case, Hayes exceeded the recommendation.

“I am very happy with the court’s sentence in this case,” Charlevoix County Prosecuting Attorney Allen Telgenhof said.  “This defendant chose to prey upon a middle school girl for his own satisfaction.  It is significant to get this type of a consequence without having to put the victim through the added trauma of testifying at trial.”

“The victim was very brave to come forward and because of her it is likely that other girls will not be assaulted,” Telgenhof continued.  “This also was the result of an excellent investigation by Michigan State Police Troopers Jeff Mercer and Jeremiah Roberts.”

Hammond also has pending Criminal Sexual Conduct charges related to another underage victim.  According to Telgenhof, that case came to light based upon correspondence between Hammond and the girl while he was in jail.

“The inmate’s correspondence is reviewed by jail staff and it appears that this defendant, while in jail for sexual relations with a 13-year-old, was already planning further sexual relations with another young girl with whom he had already engaged in sex,” Telgenhof said.  “That case has not been adjudicated, though, and the defendant is presumed innocent until he is proven guilty beyond a reasonable doubt in a court of law.”
